Rep. Bishop works with NCDHHS to Secure Flexibility for Hospitals Caring for COVID-19 Patients

March 24, 2020

WASHINGTON, D.C.-- Congressman Dan Bishop (NC-09) released the following statement on waivers for North Carolina Section 1135 laws. The waivers remove certain regulations and requirements for hospitals, allowing them to rapidly increase capacity during the coronavirus pandemic.

"Throughout this national emergency, hospitals need flexibility to quickly implement innovative care and increase capacity," said Rep. Bishop. "I applaud the Centers for Medicare and Medicaid Services (CMS) for heeding this bipartisan request from Congressman Budd (NC-13), Congressman Price (NC-4) and myself to allow care for the influx of coronavirus patients in North Carolina's hospitals."

In addition to the blanket waivers previously approved by CMS, this waiver provides needed flexibility for North Carolina to enroll new providers, provide services in an alternative setting, waive assessment requirements for admission to nursing facilities, allow Medicaid enrollees more time to request a Fair Hearing and suspend Medicaid prior authorization requirements in order to better combat the COVID-19 pandemic.
